Re-Zoning for 'Cherokee Lots' Coming Before GPNA in September
Cherokee Lots - PROPOSED Conditions to be Reviewed by GPNA
The lots being discussed for re-zoning are on Cherokee Avenue, between Augusta Avenue and Grant Park Place. The following list of proposed conditions has been developed by representatives of the GPNA, of the immediate neighbors of the lots, and of Urban Green Properties, based on concerns and questions that have been raised to date. These are proposed conditions only, crafted for presentation to and potential revision by the GPNA and NPU-W.

Site Plan Conditions (including setbacks, parking, density, etc.)

(1) The development will be limited to five (5) single family lots, nine (9) townhome lots, two (2) live-work units fronting Cherokee Avenue, eight (8) condominiums and 3,500 square feet of commercial space.

PERMITTED SUBSTITUTIONS: Four (4) live-work units or townhomes may be substituted for the eight (8) condominium units and 3,500 square feet of commercial space. Further, townhomes may be substituted for the two (2) live-work units fronting Cherokee Avenue. No further substitutions are permitted.

(2) One (1) off-street parking space will be provided per bedroom for the condominium units. Two (2) off-street parking spaces will be provided for each of the single-family homes and townhomes.

(3) A 4-foot setback will be provided between the single family lots.

(4) A 4-foot setback will be provided along the Western Property line excluding the duplex property at 410-412 Grant Park Place. The setback will be landscaped with a street tree every 30 feet and a variety of shrub material.

(5) The private drives of the development will not connect to the existing alley. If a connection is requested at the southern-most private drive directly behind the existing duplex, the site plan revision request must be accompanied with a plan for improving the alley running parallel to and immediately west of the western property line.

(6) Five (5) days prior to any application or petition for administrative approval or modification of the site plan, the property owner shall provide copies of the application or petition to the chair of the GPNA Land Use & Zoning Committee and Mr. Robert B. Ahdieh (as representative of the immediate neighbors of the property), as well as the chair of the NPU-W Land Use & Zoning Committee and Grant Park’s City Council representative. Design/Elevation Conditions

(7) All designs for structures in the development will be submitted to the Urban Design Commission for a Certificate of Appropriateness.

(8) The building at the corner of Augusta Avenue and Cherokee Avenue will be designed to be compatible with the existing building at the northwest corner of Augusta Avenue and Cherokee Avenue, and to be consistent with the historic architectural style of the Grant Park neighborhood. It will not exceed a height of 35 feet to the principal structure. Any parapets above the principal structure will not exceed a height of 2.5 feet.

(9) The nine interior townhomes will be designed to be consistent with the historic architectural style of the Grant Park neighborhood.

(10) The single family homes will be designed to be consistent with the historic architectural style of the Grant Park neighborhood.

(11) Five (5) days prior to the submission to the Urban Design Commission (UDC) of an application or petition for a Certificate of Appropriateness, or of an application or petition to alter a previously approved design, for any building to be constructed on the property, the property owner shall provide copies of the application or petition to the chair of the GPNA Land Use & Zoning Committee and Mr. Robert B. Landscaping and Related Conditions

(12) If the number of trees required by the Tree Protection Plan cannot fit on the property, the remaining trees will be provided to the Grant Park Neighborhood Association, in lieu of a payment to the Tree Bank.

(13) Five (5) days prior to the submission of any Tree Protection Plan, any application for a Land Disturbance Permit, or any application or petition to alter a previously approved plan, the property owner shall provide notice of the application or petition to the chair of the GPNA Land Use & Zoning Committee and Mr. Robert B. Ahdieh (as representative of the immediate neighbors of the property). Addresses are as follows:

(14) No fencing will be placed around the perimeter of the property. Fencing for the five (5) single-family homes will be allowed, but must meet the fencing ordinance applicable to the Grant Park neighborhood. Additionally, no gates will be permitted across property entrances or exits, upon completion of construction.

(15) There will be no monument signs on the property.

Miscellaneous Conditions

(16) Construction and construction-related deliveries will take place only between 7:00 a.m. to 7:00 p.m. on weekdays, and 9:00 a.m. to 7:00 p.m. on weekends.

Five (5) days prior to the submission of any work-hour variance application, the property owner shall provide copies of the application or petition to the chair of the GPNA Land Use & Zoning Committee and Mr. Robert B. (17) Wheeled garbage cans (“herbie curbies”) will be used for the complete site. The townhomes, condominium units, and commercial units will have interior pick-up sites. Private garbage pick-up will be utilized for the interior pick-up sites if the City of Atlanta will not pick up from the interior locations.

(18) The property will not have a separate name. The name will be the same as the neighborhood in which it is located.
